I have been practicing law since 1988. I provide highly personal service to a select group of clients, both individuals and businesses. My goal is to render effective legal services in the most cost efficient way possible and costs include both attorneys fees as well as the cost of ongoing, protracted litigation.
I began practicing in Winston-Salem, North Carolina after graduating from law school in May of 1988 where I tried my first jury trial that fall. I moved to Charleston and was licensed in South Carolina in 1992 and have been a member in good standing of the Charleston County and South Carolina Bar ever since. I have been practicing mostly litigation related law since then representing clients from large multinational corporations to successful business owners to individuals who did not think they could even afford a lawyer. My goal in advising my clients is to help guide them so as to avoid litigation, to help them resolve problems without litigation when it can be avoided, but when it cannot, I am prepared to represent my clients in all State and Federal Courts in South Carolina. I represent both plaintiffs and defendants.
I practice mostly in the area of contract law and the disputes that arise from contracts. Contract law includes most of what we (lawyers and litigants) litigate in Civil Court except for Tort law which is primarily personal injury. For example, "Contract Law" includes business and partnership agreements, insurance policies, banking disputes, credit card and other debt related disputes, debt collection, leases, Wills and Trusts, among the many other "agreements" that are part of our everyday life. I do handle personal injury claims, if they are serious and legitimate, but I do not advertise for nor focus on injury cases. While I do not practice "Divorce Law" (but often help my clients find the right divorce lawyer for them) but I frequently assist many businesses that have executives, officers or employees who are involved in Family Court cases in compliance with the discovery that involves their businesses so as to protect proprietary or confidential information and ensure that those businesses respond promptly and appropriately to Family Court subpoenas and Orders.
I represent Medical practices in contract matters and in compliance with subpoenas so as to protect their patients privacy and ensure their compliance with HIPPA.
I provide litigation guidance and support for large and medium sized companies as well as growing businesses.
I represent people and Estates in Probate Court in the litigation over Wills and Trusts and often assist in conservator matters in the Probate Court.
In the area of Wills and Trusts, we have just made new law in South Carolina effective October 29, 2014! Please see the South Carolina Supreme Court's Opinion in Fabian v. Lindsay, here wherein my team (including lawyer Thomas Pendarvis, Esq. of Beaufort, SC) prevailed and achieved a victory for all named beneficiaries in negligently drafted Wills and Trusts.
